An international assignment can present various challenges. A typical German household maintains around 70 individual contracts to manage everyday needs. Handling these agreements can be demanding for anyone. HEUSER RECHT UND STEUERN is at your disposal to provide professional assistance in this area.

Usually, departing employees must complete and file several mandatory declarations with municipal, tax, and other public authorities. HEUSER RECHT UND STEUERN can also fulfil these obligations and file such declarations while acting as an authorised representative and trustee.

We understand that working abroad for professional reasons can be a significant burden. Taking this into account is of vital importance to maintaining a strong relationship with our clients.

Impatriates

Our services

This section is intended for all foreign nationals living and working in Germany. For many, the legal and tax systems of the Federal Republic of Germany may be unfamiliar. To help you navigate German life and culture, we have published the magazine Navigating Germany in cooperation with several other sponsors.

Navigating Germany is designed for all English-speaking foreign nationals residing in Germany. There is no German-language edition of this magazine.

Immigration

  • Application for- Visa- Work Permit- Residence Permit

  • administrative procedures

  • suit at law

Germany regulates its labour market like any other country. Engaging in professional activity in another country requires both a residence permit and a work permit. Authorisation is subject to the submission and approval of an application. All requirements applicable under German law must be met. Anyone who does not possess the required residence and work permit must expect to be expelled from Germany. This applies to all professional groups and levels of employment.

In many cases, the specific authorisation requirements for accompanying family members are overlooked.

Entry formalities must be clarified well in advance, as they can be bureaucratic and time-sensitive. Professional assistance is therefore strongly recommended.

Social insurance

  • pension insurance

  • health insurance

  • nursing care insurance

  • unemployment insurance

  • casualty insurance

  • Determination of country-specific contributions

  • social security strategies

The social security status changes in the case of cross-border employment in one or more countries. The specific provisions of bilateral social security agreements have the same impact as those of a foreign social security system with its own requirements.

Impatriates often wish to receive social security protection equivalent to that in their home country.

They often fear that their social security coverage in Germany will be less favourable.

Insurance cover

  • Identification of insurance gaps

  • Development of contractual solutions

In many cases, the benefits provided by the statutory social insurance institutions are not sufficient. In such cases, coverage should be supplemented by complementary or substitutive insurance solutions.

Working in Germany entails numerous new risks that may not have existed previously. Existing insurance coverage should therefore be reviewed and updated accordingly.

Income tax

  • net salary calculation

  • Tax returns at home and abroad

  • compensation models

  • control strategies

If you work in another country, the right of taxation is transferred to the country of employment, depending on the duration of your stay and the applicable residence rules. The specific provisions of the applicable foreign income tax law will then apply, potentially affecting the amount of net disposable income. A net salary calculation is therefore essential.

Due to increasingly complex regulatory frameworks at the international level, it is necessary to prepare tax returns both in the home country and in Germany. This requires expert local support, which our firm is able to provide.

Upon returning to the home country, proof of proper taxation of income earned in Germany is now required in many cases. An individual tax strategy can therefore be highly beneficial, particularly as foreign tax systems may also offer certain advantages.

Drafting of contracts

  • drafting of contracts

  • conflict of laws

  • protection against dismissal

  • conduct of a case

  • Company pension scheme

The structuring of assignments, delegations, and localisations is a demanding task. The challenge lies in the complexity of the legal and regulatory framework. The legal particularities require carefully tailored solutions for each individual case. In addition to the employment contract, there are further duties of disclosure and information. Legal certainty can only be ensured through professional legal advice.

The various forms of global employment relationships must be regulated consistently and without contradiction.

The contract should take into account the insurance and tax specifics of the individual case.

The management and administration of international employment contracts require numerous individual measures and specialised expertise.

Country-specific legal requirements must often be observed and implemented to avoid potential liabilities.
